1. Acceptance of Terms

By accessing or using the NFTPAO platform ("Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our Service. We reserve the right to modify these terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Eligibility

You must be at least 18 years old to use our Service. By using NFTPAO, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. You are responsible for ensuring that your use of the Service complies with all laws applicable to you.

3. Account Registration

To access certain features, you must create an account by:

  • Connecting a compatible cryptocurrency wallet (e.g., MetaMask), or

  • Registering with your email address

You are responsible for maintaining the security of your account credentials and wallet private keys. We are not liable for any loss arising from unauthorized access to your account.

4. NFT Auctions and Bidding

4.1 Placing Bids

  • All bids are binding and cannot be withdrawn once placed

  • Bids must be higher than the current highest bid

  • By placing a bid, you authorize the deduction of funds from your wallet

  • Outbid amounts are automatically returned to your wallet

4.2 Winning Auctions

  • The highest bidder at auction end wins the NFT

  • NFTs are transferred automatically upon auction completion

  • All sales are final; no refunds are available

5. Fees and Payments

Using our Service may involve the following fees:

  • Network gas fees for blockchain transactions

  • Platform fees as disclosed at the time of transaction

  • Creator royalties on secondary sales

All fees are non-refundable. Gas fees are paid to the Polygon network and are outside our control.

6. Intellectual Property

When you purchase an NFT, you receive ownership of the token on the blockchain. However:

  • Copyright and intellectual property rights remain with the original creator unless explicitly transferred

  • You may not use NFT artwork for commercial purposes without proper licensing

  • Each NFT collection may have specific terms regarding usage rights

7. Prohibited Activities

You agree not to:

  • Use the Service for any illegal purpose

  • Manipulate auctions through wash trading or bid manipulation

  • Create or list counterfeit or infringing NFTs

  • Attempt to interfere with or compromise the Service

  • Use bots or automated systems to gain unfair advantages

  • Engage in money laundering or terrorist financing

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE:

  • The value or future value of any NFT

  • Uninterrupted or error-free operation of the Service

  • The authenticity of third-party content

  • That blockchain transactions will always process successfully

9. Limitation of Liability

To the maximum extent permitted by law, NFTPAO and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses resulting from your use of the Service.

10. Indemnification

You agree to indemnify and hold harmless NFTPAO, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Zurich, Switzerland.
